Welcome to Taya Beauty.

The terms “Taya Beauty,” “we,” “us,” and “our” refer to Taya Beauty, operated by DAI Enterprises LLC. We operate this website and online store, including all related information, content, features, customer accounts, tools, products, and services collectively referred to as the “Services.”

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when you visit, interact with, or use the Services.

Please read these Terms carefully. By accessing or using the Services, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not access or use the Services.

Nothing in these Terms limits any consumer rights that cannot legally be waived or restricted.

SECTION 1 — ELIGIBILITY, ACCESS, AND CUSTOMER ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have the consent of a parent or legal guardian where required.

To access certain features or place an order, you may be asked to provide information such as your name, email address, billing address, shipping address, and payment information. You agree that the information you provide will be accurate, current, and complete.

Customer accounts may use passwordless authentication, one-time verification codes, Shop sign-in, or other available authentication methods. You are responsible for maintaining the security of your email account, devices, verification codes, and account access.

You may not transfer, sell, assign, or license your customer account to another person. Please notify us promptly if you believe your account has been accessed without authorization.

We reserve the right to suspend, restrict, or terminate access to an account when we reasonably believe it has been used fraudulently, unlawfully, or in violation of these Terms.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to present our products and their colors, textures, packaging, ingredients, sizes, and other characteristics accurately. However, appearance may vary depending on your device, screen settings, lighting, product batch, packaging updates, or other factors.

Product images may include styling elements, props, digital renderings, or enlarged details intended to help illustrate product features.

Descriptions, formulas, packaging, pricing, availability, and product assortments may change without notice. We may discontinue a product or limit quantities available to any customer, location, or jurisdiction.

Our hair-care and beauty products are intended for cosmetic use as directed. Product information provided through the Services is for general informational purposes and is not medical advice. Individual experiences and results may vary.

Please review product instructions and ingredient information before use. Discontinue use and seek appropriate professional guidance if irritation or an adverse reaction occurs.

Products purchased through the Services are intended for personal or household use. You may not purchase products for unauthorized commercial resale, redistribution, or export.

SECTION 3 — ORDERS AND ORDER ACCEPTANCE

Placing an order constitutes an offer to purchase the selected products.

An automated order confirmation acknowledges that we received your order, but it does not necessarily constitute final acceptance. We reserve the right to accept, decline, limit, modify, or cancel an order for legitimate reasons, including:

  • Product or inventory availability
  • Pricing or description errors
  • Suspected fraud or unauthorized payment activity
  • Shipping restrictions
  • Unusually large quantities or suspected unauthorized resale
  • Violations of these Terms or applicable law

If we decline or cancel an order after payment has been authorized or collected, we will issue the appropriate reversal or refund.

Please review your order, delivery address, and payment information carefully before submitting it.

Eligible unfulfilled items may be submitted for cancellation through your Taya Beauty customer account until the item is fulfilled. Cancellation requests are subject to review and are not complete until approved and processed by Taya Beauty.

Once an item has been fulfilled, it can no longer be canceled and may instead be eligible for return under our Return & Refund Policy.

Purchases made through Amazon, HSN, QVC, or another authorized retailer are transactions with that retailer and are subject to the retailer’s own ordering, payment, shipping, cancellation, and return policies.

SECTION 4 — PRICES, PROMOTIONS, AND PAYMENT

Prices, promotions, discounts, gifts with purchase, shipping offers, and product availability may change without notice.

The price charged will be the price displayed at checkout when the order is submitted, subject to correction of errors. Unless expressly stated otherwise, displayed product prices may not include shipping, taxes, duties, customs charges, brokerage fees, or other destination-related charges.

Promotions may be governed by separate terms, including eligibility requirements, exclusions, expiration dates, quantity limits, and restrictions on combining offers. If promotional terms conflict with these Terms, the specific promotional terms will control for that promotion.

You agree to provide accurate and complete billing and payment information. You represent that you are authorized to use the selected payment method and authorize us and our payment providers to charge the applicable amount.

We may correct pricing, promotional, shipping, tax, or product-information errors and may cancel or adjust an affected order. If an adjustment increases the amount owed, we will request your authorization before proceeding where required.

SECTION 5 — SHIPPING AND DELIVERY

Orders are processed and shipped according to our Shipping Policy.

Processing and delivery timeframes are estimates and are not guaranteed. Delivery may be affected by carrier operations, severe weather, holidays, customs processing, address issues, product availability, or events outside our reasonable control.

Available shipping methods, estimated transit times, and charges are displayed at checkout based on the order, destination, and available services.

You are responsible for providing a complete and accurate shipping address. Please contact us promptly if you notice an error. We cannot guarantee that an address can be changed after fulfillment has begun.

International orders may be subject to duties, import taxes, customs assessments, brokerage charges, or other destination-related fees. Treatment of these charges depends on the destination and the checkout method used.

Responsibility for loss or damage during delivery will be determined according to applicable law and the circumstances of the shipment.

SECTION 6 — RETURNS, REFUNDS, AND CANCELLATIONS

Returns, return eligibility, return-shipping charges, refunds, damaged items, international returns, and final-sale exclusions are governed by our Return & Refund Policy.

Submitting a return or cancellation request does not automatically approve the request, generate a return label, cancel an order, or issue a refund.

Please do not send merchandise back before receiving authorization and return instructions from Taya Beauty.

Approved refunds are processed according to the original payment method unless otherwise required by law or agreed by Taya Beauty.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and their contents—including trademarks, trade names, logos, product names, text, photographs, graphics, videos, audio, product descriptions, illustrations, page layouts, designs, and other materials—are owned by or licensed to DAI Enterprises LLC and are protected by applicable intellectual-property laws.

Taya Beauty names, logos, product names, designs, packaging elements, slogans, and brand assets may not be used without prior written permission.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, lawful, and non-commercial purposes.

Without our prior written permission, you may not:

  • Copy, reproduce, republish, distribute, sell, or commercially exploit the Services or their contents
  • Modify or create derivative works from our content
  • Use our trademarks, branding, images, or product copy
  • Frame or mirror any portion of the website
  • Remove intellectual-property notices
  • Use the Services to develop or train competing products, systems, or commercial datasets
  • Collect information from the Services through scraping, crawling, or unauthorized automated means

All rights not expressly granted are reserved.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services may provide access to tools, applications, payment methods, sign-in services, social-media features, analytics, reviews, shipping services, or other functionality provided by third parties.

We do not control and are not responsible for the content, security, availability, accuracy, products, services, or practices of third-party websites.

Questions or claims regarding third-party products or services should be directed to the applicable third party.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Taya Beauty is powered by Shopify, which enables us to provide the Services to you.

Any sale or purchase made through our store is made directly between you and Taya Beauty. Shopify is not the seller of Taya Beauty products and is not responsible for the products, order fulfillment, customer service, or other aspects of the transaction between you and Taya Beauty.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising directly from purchases and transactions made with Taya Beauty, except for claims resulting from Shopify’s own independent acts or obligations.

SECTION 11 — PRIVACY

Personal information collected through the Services is handled according to our Privacy Policy.

Because the Services are hosted by Shopify, Shopify and authorized service providers may collect and process information necessary to operate, secure, improve, and personalize the Services.

Please review our Privacy Policy for information about the categories of personal information collected, how information is used and disclosed, cookies and similar technologies, international transfers, retention, and privacy rights.

SECTION 12 — REVIEWS, FEEDBACK, AND USER CONTENT

You may choose to submit reviews, photographs, comments, suggestions, questions, testimonials, ideas, or other content collectively referred to as “User Content.”

You retain any ownership rights you have in your User Content. By submitting it to us, you grant Taya Beauty a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, display, distribute, and promote that User Content in connection with our business, products, marketing, and Services, subject to applicable law.

You represent that:

  • You own or have permission to submit the User Content
  • The content is accurate to the best of your knowledge
  • You have disclosed any material connection, compensation, gift, or incentive associated with the submission
  • The content does not violate another person’s rights
  • The content is not unlawful, fraudulent, defamatory, threatening, obscene, or malicious

We may moderate, decline, edit, or remove User Content where permitted by law, but we are not obligated to monitor every submission.

SECTION 13 — ERRORS, INACCURACIES, AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product information, pricing, promotions, availability, shipping charges, transit times, or other details.

We reserve the right to correct errors, update information, or cancel affected orders, subject to applicable law.

We are not obligated to update every piece of information except where required by law.

  • Scrape, crawl, extract, index, or collect content or personal information without authorization
  • Impersonate another person or misrepresent your identity or affiliation
  • Purchase products for unauthorized commercial resale
  • Use the Services in any manner that could expose Taya Beauty, Shopify, our customers, or third parties to harm or liability

We may suspend or terminate access where we reasonably determine that these restrictions have been violated.

SECTION 15 — AUTOMATED SYSTEMS AND AGENTS

Automated, autonomous, or semi-autonomous software systems may not access or interact with the Services in a deceptive manner, bypass technical restrictions, misrepresent themselves as human users, circumvent CAPTCHAs, or disregard instructions intended to limit automated access.

We may restrict or block automated access where necessary to protect customers, intellectual property, website performance, security, or lawful business interests.

SECTION 16 — TERMINATION

You may stop using the Services at any time.

We may suspend or terminate your access to all or part of the Services when reasonably necessary, including for suspected fraud, unlawful activity, security concerns, abuse, or material violation of these Terms.

Termination does not affect rights or obligations that arose before termination.

Sections that by their nature should survive termination—including intellectual property, privacy, User Content licenses, disclaimers, limitations of liability, indemnification, governing law, and amounts owed—will remain effective.

SECTION 17 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services are provided on an “as available” basis.

We do not guarantee that the Services will always be uninterrupted, secure, error-free, or available, or that every defect will be corrected immediately.

Product warranties and statutory consumer protections that cannot legally be excluded remain unaffected.

Except where expressly stated or required by law, we disclaim implied warranties relating to the Services, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Some jurisdictions do not permit certain warranty exclusions, so some of these provisions may not apply to you.

SECTION 18 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, or other liability protected by applicable law.

To the fullest extent permitted by law, Taya Beauty, DAI Enterprises LLC, and their members, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from your use of the Services.

Where liability may lawfully be limited, our aggregate liability arising from a claim relating to an order will not exceed the amount you paid to Taya Beauty for the product or order giving rise to the claim.

These limitations do not affect statutory rights or remedies available to consumers under applicable law.

SECTION 19 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Taya Beauty, DAI Enterprises LLC, Shopify, and their respective affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from:

  • Your material violation of these Terms
  • Your unlawful misuse of the Services
  • Your infringement of another party’s rights
  • User Content submitted by you that violates applicable law or third-party rights

This obligation does not apply to the extent a claim results from the negligence, misconduct, or independent legal responsibility of the party seeking indemnification.

SECTION 20 — SEVERABILITY

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or modified to the minimum extent necessary.

The remaining provisions will continue in effect.

SECTION 21 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with the policies incorporated by reference and any applicable promotional or transaction-specific terms, constitute the agreement between you and Taya Beauty regarding your use of the Services.

If a specific policy or promotional term conflicts with these Terms, the more specific term will govern the subject it addresses, to the extent permitted by law.

SECTION 22 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, financing, sale of assets, change of control, or similar business transaction, subject to applicable law.

SECTION 23 — GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where the mandatory laws of your place of residence apply.

To the extent permitted by law, disputes that cannot be resolved informally will be brought in the appropriate state or federal courts located in Miami-Dade County, Florida.

Nothing in this section prevents a consumer from exercising rights or bringing a claim in another jurisdiction where applicable law requires or permits it.

SECTION 24 — ELECTRONIC COMMUNICATIONS

You agree that we may provide order confirmations, account notices, policy updates, disclosures, and other transactional communications electronically, including by email, through your customer account, or by posting them through the Services.

This consent is separate from your marketing preferences. You may unsubscribe from promotional emails without affecting necessary transactional communications about your orders or account.

SECTION 25 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes to the Services, our business practices, applicable law, or other operational requirements.

The current version will be posted on this page with the revised “Last updated” date. Where required by law, we will provide additional notice of material changes.

Changes will apply prospectively from their stated effective date. Your continued use of the Services after an update becomes effective constitutes acceptance of the revised Terms, except where applicable law requires another form of consent.
